  1. Acceptance of Terms of Use

Thank you for visiting our Women in Film and Television Toronto (“WIFT-T”) Website.  WIFT-T maintains this website (the “Website“) for your personal information, entertainment, education and communication use.

This “Terms of Use” agreement sets forth the legally binding terms and conditions for your use of the Website.  By your access to and use of the Website in any manner, including but not limited to visiting and browsing the Website, you agree to be bound by these Terms of Use and all applicable laws, without limitation or qualification, and acknowledge that any other agreements between you and WIFT-T regarding the Website are superseded and of no force or effect. This Terms of Use agreement includes the Terms of Use and also incorporates by reference the Privacy Policy at www.wift.com and all other operating rules, policies and procedures that may be published from time to time on the Website by WIFT-T and applies to all users of the Website, including users who are also contributors of content, information, and other materials or services on the Website.

If you do not agree to these Terms of Use please do not use this Website.

  1. Modification of Terms of Use

The Terms of Use apply to all users of this Website and may be changed without warning, at WIFT-T’s discretion. By your continued use of this Website, you agree to monitor these Terms of Use for any changes, and agree that these changes will be binding upon you, except as expressly set forth within any separate notice contained on the Website or as between you and WIFT-T in any separate agreement.

None of these Terms of Use may be waived, except as a result of a written agreement signed by an officer of WIFT-T.

These Terms of Use constitute the entirety of the agreement between you and WIFT-T.  If you are dissatisfied with these Terms of Use, your sole and exclusive remedy is to cease to use this Website.

All material on this Website, including but not limited to text, audio, video, graphics, photographic images, button icons, and software code, belongs to WIFT-T and is copyrighted as a collective work under the laws of Canada, the United States and other international copyright protected jurisdictions and is the property of WIFT-T. The content of this Website may not be reproduced, distributed, displayed, transmitted, modified, reused, copied, reposted or otherwise used for public or commercial purposes without WIFT-T’s express written permission. Any unauthorized use of this content is a breach of these Terms of Use and may be a violation of law. Subject to the terms and conditions of this Terms of Use, WIFT-T hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use the Website by displaying it on your internet browser only for the purpose of viewing information, purchasing tickets, memberships, programming or other services, and communicating with WIFT-T representatives and not for any commercial use or use on behalf of any third party, except as explicitly permitted by WIFT-T in advance in writing. All rights not expressly granted in these Terms of Use are reserved to WIFT-T.

All trade-marked words, phrases, logos, designs, symbols and characters, service marks and trade names (collectively, the “Trade-marks“) used on this Website are the property of WIFT-T, unless otherwise indicated, in which case, they are used with permission. The Trade-marks may not be copied, reproduced, distributed, displayed, transmitted, modified, reused, copied, reposted or otherwise used for public or commercial purposes without WIFT-T’s express written permission.

All registered and unregistered trade-marks are protected by the trade-mark laws of Canada, the United States and other international trade-mark protected jurisdictions and are the property of WIFT-T.

  1. Submissions to the Website

Any information, communications or material, including without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively “Submissions“) you submit to WIFT-T at this Website, by e-mail, download, or otherwise, is non-confidential and non-proprietary, and WIFT-T shall have a royalty-free, worldwide, perpetual, irrevocable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such Submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble or decompile such Submissions. 

Specifically, WIFT-T is free to use any ideas or concepts contained in any such Submissions for any purpose whatsoever, including, but not limited to, developing, manufacturing, advertising and marketing products and services.  Any such use is without compensation to the person submitting.  If WIFT-T accepts your Submissions and specifically agrees to keep it confidential or not use it, nonetheless WIFT-T does not waive any rights it may have to similar or related ideas or concepts previously known to WIFT-T or developed by WIFT-T’s employees, or obtained from sources other than you.  You further acknowledge and warrant that the Submissions contain only your own material and content or material and content that you have undeniable rights to use, and WIFT-T’s use will not violate any third party’s rights.  WIFT-T is under no obligation to use any Submission.

  1. Content Submissions Policy

Although WIFT-T may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the Website (“Postings“), WIFT-T is under no obligation to do so and assumes no responsibility or liability arising from the content of any such Posting, nor any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger or inaccuracy, contained in any information within such Postings on the Website.

You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability or otherwise violate any law.  You may not upload commercial content on the Website or use the Website to solicit others to join or become members of any other commercial online service or other organization. 

In addition to the rights applicable to any Submission, when you post comments to the Website, you also grant WIFT-T the right to use the name that you submit with any comment, or other content, if any, in connection with such comment, or other content. For certain activities on this website, for example accessing MemberFindMe, you are required to have an account name and a password.  It is solely your responsibility to keep your account information and password secure, and you agree to accept responsibility for all activities that occur under your account or password. You agree to notify WIFT-T immediately of any unauthorized use of your account.


You warrant that you are over 18 years of age when placing an order to purchase any product or service, and that you are providing accurate, true, and complete information, and that you have the authority to place the order. We reserve the right to terminate your account and restrict your use of this site if we have reason to believe you have violated any of these Terms of Use.

 

  1. Pricing and Payment Policies

Prices for products or services from WIFT-T are described on the Website and are incorporated by reference into this Terms of Use. All prices are in Canadian dollars. Prices, products and services may change at WIFT-T’s discretion. Title and risk of loss for all products ordered by you shall pass to you once you have submitted your payment for the product and once payment has been confirmed by WIFT-T.

 

  1. Typographical Errors

The information and product or service listings on this Website may contain typographical errors, inaccuracies and omissions or may not be current or complete.  We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.  Please note that such errors, inaccuracies or omissions may include but are not limited to product or service description, pricing and availability and to details regarding events and contests. In the event that a WIFT-T product or service is mistakenly listed at an incorrect price, WIFT-T reserves the right to refuse or cancel any orders placed for the product or service listed at the incorrect price. WIFT-T reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, WIFT-T shall issue a credit to your credit card in the amount of the incorrect price.

These kinds of personal information are used for billing purposes, to process a membership application, program application or purchase, to communicate with you about events, news and services and for internal marketing purposes. If we encounter a problem when processing any order or application, your personal information may be used to contact you.

(b)               Phone communications: If you contact one of our representatives, we may ask you for information such as your name, address and email address so we can respond to your questions or concerns. With your consent, we may retain this information to personalize your experience with us and better assist you the next time you contact us.

(c)                Email Addresses: Several locations on the Website permit you to enter your email address for purposes including but not limited to: to register for a contest or other opportunity; to sign up for email newsletters; or to sign up for a WIFT-T membership.   1. How to unsubscribe from the WIFT-T newsletter and disable your WIFT-T account

Upon your request we will stop sending emails to your email address and/or disable your account to prevent any future activity through that account. You can make this request by emailing wift@wift.com or by calling 416-322-3430 extension 221.

You can unsubscribe from the WIFT-T newsletter by clicking the “unsubscribe” button in our email newsletter.

We take your privacy seriously. We only share your personal information when it is necessary to complete your order or provide memberships.
